Hey there! We’ve created this Privacy Policy so you’ll know how important your data is to us. So, read on and let us explain our practices regarding the collection, use and disclosure of information that we receive through our website and mobile application (collectively, “Services”).
This Privacy Policy does not apply to any third-party websites, services or applications, even if they are accessible through our Services. Also, to keep things simple, all capitalized terms used in this Privacy Policy have the same meanings as in our Terms of Service. So, please make sure that you have read and understand our Terms of Service.
This Privacy Policy applies to the Services provided by ProActive FinTech LLC. (“ProActive”, “we”, or “us”).
We may revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we’ll let you know of those changes by posting them on the “Services” or by sending you an email or other notification, and we’ll update the “Last Updated Date” above to indicate when those changes will become effective.

Collection of Information

Information Collected Or Received From You
We collect nonpublic personal information you provide to us when you apply for a ProActive account or when you communicate with us about your ProActive account. The types of information we may collect include your name, address, phone number, email address, date of birth, bank account information, social security number, password, (collectively, “PII”) and any other information you choose to provide.
Information About Your Transactions With Us
As you use your ProActive account to perform financial transactions, we collect nonpublic personal information in connection with each transaction, including transaction time, dollar amount and merchant details. We may also collect photos, memos or other information that you attach to your transactions.
Information From Other Sources
When you create a ProActive account, we may collect information, including nonpublic personal information, about you from nonaffiliated third party service providers in order to verify your identity and for fraud prevention, including your prior addresses and names.
Information We Collect Automatically from our Services
When you access or use our Services, we automatically collect information about you as follows:

  • Log Information: We log information about your use of our Services, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Services.
  • Device Information: We collect information about the computer or mobile device you use to access our Services, including the hardware model, operating system and version, unique device identifiers and mobile network information.
  • Location Information: We may collect your location information from your mobile device with your prior consent. For information about how to disable the collection of location information from your device, please see “Your Choices” below.
  • Information Collected by Cookies and Other Tracking Technologies: We use various technologies to collect information on our Services and other websites, and this may include sending cookies to your computer or mobile device. Cookies are small data files stored on your hard drive or in device memory that help us to improve our Services and your experience, see which areas and features of our Services are popular and count visits. Web beacons are electronic images that may be used in our Services or emails and help deliver cookies, count visits, understand usage and campaign effectiveness and determine whether an email has been opened and acted upon.
  • How We Respond to Do Not Track Signals: We allow Do Not Track browser configurations. We use cookies and other tracking technologies, and Do Not Track status may alter the available services with certain browsers, when these tracking functionalities are used to provide services. We do not alter the information our applications attempt to collect based on your Do Not Track configuration.

Use of Information

We will not share any PII that we have collected from or regarding you except as described below:

Information Shared with Our Services Providers. We engage third-party services providers to work with us to administer and provide the Services. These third-party services providers have access to your PII only for the purpose of performing services on our behalf. ProActive will share your PII with: Dwolla for the purposes of providing you with Funds Transfer Services, Yodlee for the purposes of Account Aggregation, and a PrePaid Debit Card Program to open and maintain a prepaid card account (including, but not limited to the UPside Card).

Information Shared with Third Parties. We may share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling and other similar purposes.

Information Disclosed for Our Protection and the Protection of Others. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to respond to claims, legal process (including subpoenas); (ii) to protect our property, rights and safety and the property, rights and safety of a third party or the public in general; and (iii) to stop any activity that we consider illegal, unethical or legally actionable activity.

Your Choices

We offer you choices regarding the collection, use and sharing of your PII and we’ll respect the choices you make. Please note that if you decide not to provide us with the PII that we request, you may not be able to access all of the features of the Services.

Opt-Out. We may periodically send you free newsletters and e-mails that directly promote our Services. You may opt out of such promotional communications from us by following the unsubscribe instructions provided in that e-mail. Please note if you do opt out, we may still send you certain transactional or relationship messages, such as those regarding updates to our Terms of Service or Account-related notifications.
Location Information. If you initially consent to the collection of location information by ProActive within our mobile application, you may be able to subsequently stop this collection through your device operating system settings or through your online account settings. If either of these opt-out options are not available to you, you may also disable location information by following the standard uninstall process to remove our mobile application from your device.

Modifying Your Information. You can access and modify the PII associated with your Account directly in the App by selecting the settings and navigating to the Account section. If you want us to delete your PII and your Account, please contact us at support@proactivebudget.com with your request. We’ll take steps to delete your information as soon we can, but some information may remain in archived/backup copies for our records or as otherwise required by law.

The Security of Your Information

We take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you (including your PII) from unauthorized access, use or disclosure. When you enter sensitive information on our forms, we encrypt this data using SSL or other technologies. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information. ProActive does not store your login credentials to your Financial Institution Accounts and no ProActive employee or affiliate has access to such credentials.

Social Sharing Features

Our Services may include social sharing features for common social networks to let users share content. These features are served from third-party services that may serve their own cookies. The use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.

Links to Other Sites

Our Services may contain links to websites and services that are owned or operated by third parties, including, but not limited to, the Funds Transfer Services provided by Dwolla, (each, a “Third-party Service”). Any information that you provide on or to a Third-party Service or that is collected by a Third-party Service is provided directly to the owner or operator of the Third-party Service and is subject to the owner’s or operator’s privacy policy. We’re not responsible for the content, privacy or security practices and policies of any Third-party Service. To protect your information, we recommend that you carefully review the privacy policies of all Third-party Services that you access.

Our Policy Toward Children

Our Services are not directed to children under 13 and we do not knowingly collect PII from children under 13. If we learn that we have collected PII of a child under 13 we will take steps to delete such information from our files as soon as possible.
